JUDGMENT 1. This application under Section 439 Cr.PC , has been filed praying for bail of the petitioner, namely, Raj Mamud Ali, who is in detention in connection with Chhaygaon P.S. Case No. 1069/2019 under Section 354(A)/376/147/148/448/323/427 IPC. 2. Heard Mr. N. Uddin, learned counsel and Mr. T.K. Mishra, learned Addl. P.P. for the respondent. 3. Perused the FIR and the documents annexed with the petition. 4. The allegation made in the FIR is that the informant, who is a married woman resides alone as her husband was working somewhere else. The present petitioner proposed her for physical relation, which was denied by her, but inspite of that, he came to her resident and had physical relation more than one and ultimately, the member of the family caught him. A village meeting was supposed to be held but the meeting was not held and the FIR was lodged. 5. Having regard to the nature of accusation and the length of detention, further custodial detention of the petitioner is not considered necessary in the interest of investigation. Accordingly, the petitioner is allowed to be enlarged on bail of Rs. 20,000/- with one suitable surety of the like amount to the satisfaction of the learned CJM, Kamrup, Amingaon, subject, of course, to the following conditions: 1. The accused petitioner shall co-operate in the investigation as and when required; 2. The accused petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts either to the Court or to any police officer. 3. The accused petitioner shall not commit any similar offence, of which he is accused or suspected commission. 4. Bail application is disposed of. Return the case diary.
