ORDER 1. Learned counsel for the rival parties are heard through video conferencing. 2. The present petition seeks review of the final order passed in WP.8615/2020 by which the writ petition in question was dismissed by holding that the Collector, under M.P. Minor Mineral Rules, has a concurrent jurisdiction to confiscate a vehicle seized in connection with mining offence besides imposing penalty. For this purpose, reliance was placed on the five judges bench decision of this Court in the case of “Rajkumar Sahu v. State of M.P. and others [( 2019 (1) RN 257 ) =[ 2019(2) MPLJ 438 ]” (para 51 and 52). 3. Learned counsel for the review petitioner submits that the mining offence in question was committed sometime in February, 2020 when in respect of minor mineral of sand [which is the mineral involved herein] new rules had been framed, namely, M.P. Sand (Mining Transportation, Storage and Trading] Rules, 2019, which did not vest Collector with any such concurrent power of confiscation when the offender is ready and willing to pay the compounding fee or the penalty as the case may be u/R.20(1)/(2) of 2019 Rules. 4. Reading of the order under review reveals that this Court did not deal with the said 2019 Rules whereas prima facie it appears that incident which gave rise to the mining offence herein related to offence of illegal transportation of sand which was governed by 2019 Rules. 5. In view of above, there seems to be palpable error in the order under review and therefore the matter deserves to be heard in the face of 2019 Rules. 6. Consequently, the present review petition stands allowed and the W.P. No. 8615/2020 is restored to its original number to be heard on admission.
