JUDGMENT Vishnu Pratap Singh Chauhan, J. - Heard on I.A. No. 9710/2020, which is an application filed for correction in the crime number. 2. It is submitted by learned counsel for the applicant that due to typographical error, learned court below has wrongly mentioned the crime number as 938/2019 whereas the correct crime number is 968/2019, therefore, prays for necessary amendment. 3. Considering the submission made by learned counsel for the applicant, and on a perusal of FIR, it appears that the correct crime number is 968/2019, therefore, I.A. No. 9710/2020 is allowed. 4. Applicant is directed to amend the crime number 938/2019 as 968/2019. 5. Also Heard on this first bail application under Section 439 of Cr.P.C. filed on behalf of the applicant. 6. The applicant is in jail since 27/11/2019 in connection with Crime No.938/2019 registered at Police Station Madhav Nager, District Katni, for commission of offences punishable under Sections 454 and 380 of IPC. 7. The case of the prosecution against the applicant, in short, is that, the applicant along with the other co-accused entered into the house of the victim and fled away from house after taking the jewellery and some other articles. 8. Learned counsel appearing for the applicant submits that the applicant is innocent and has falsely been implicated in this case. It is further submitted that the applicant is in jail since 27/11/2019 and trial would take considerable time for its conclusion, therefore, the applicant may be enlarged on bail. 9. Learned Panel Lawyer for the respondent/State opposes the application and prays to dismiss the application. 10. Having heard learned counsel for both the parties and considering the present situation of wide spread of Covid-19 virus, this Court is inclined to release the applicant on bail. 11. Consequently, this application for bail under Section 439 of the Code of Criminal Procedure filed on behalf of applicant stands allowed. It is directed that the applicant-Rahul Vanshkar shall be released on bail on furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one solvent surety in the like amount to the satisfaction of the trial Court for his appearance before that Court on all dates fixed in the case and for complying with the conditions enumerated under Section 437 (3) of the Code of Criminal Procedure. 12.
12. This order shall be effective till the end of the trial, however, in case of bail jump, it shall become ineffective. 13. Jail authorities and State Government are directed to follow the guidelines issued by the Health Ministry in the wake of Novel Corona Virus, before and after releasing the applicant.
