JUDGMENT Sanjeev Sachdeva, J. (Oral) - The hearing was conducted through video conferencing. 2. Petitioner by this petition seeks release on parole for a period of 90 days due to critical medical condition. 3. It is contended that petitioner is suffering from several ailments and is a follow up case of Exploratory Laprotomy with Ileoascending Anastomosis with Enterocutaneous Fistula, Cholelithiasis. 4. The report of the medical officer incharge dated 27.05.2020 records that petitioner was taken to the All India Institute of Medical Sciences, however, the hospital has reported that routine operation work is not been carried out in the All India Institute of Medical Sciences because of COVID-19. 5. Learned counsel for the petitioner submits that petitioners condition is that he is not in a position to take care of himself and requires assistance of others. 6. Learned counsel for the petitioner submits that since the petitioner was examined at All India Institute of Medical Sciences as a precaution he has been put in quarantine in the jail. 7. Keeping in view the facts and circumstances, it is directed that petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the concerned Superintendent Jail. 8. It is directed that petitioner shall be released on parole only after completion of the period of quarantine subject to the condition that he does not develop any symptoms of corona. 9. Further, during the period of parole: (i) petitioner shall not leave the National Capital Territory of Delhi without prior permission of the Court; and (ii) he shall furnish to the IO his mobile number (which shall be kept active throughout) and the residential address where he would be staying during the period of parole; and (iii) in case of any change in the residential address or mobile number, he shall duly intimate the SHO/IO; and (iv) on expiry of the period of parole he shall surrender to the concerned Superintendent Jail. 10. Petition is disposed of in the above terms. 11. Copy of the Order be uploaded on the High Court website and be also forwarded to the Parties through email.
