JUDGMENT Anjuli Palo, J. - This is first application under section 439 of Cr.P.C. for grant of bail filed on behalf of applicants who are in custody in connection with Crime No. 409/2020 registered at Police Station Umaria, District Umaria (MP) for offence punishable under Sections 354, 354(A), 354(B), 323 read with Section 34 of the Indian Penal Code. 2. As per the prosecution case, on 21.08.2020, when the prosecutrix was returning home three persons followed her on motor-cycle and caught hold of her. One of them bit on her chest with teeth and the other person pressed her mouth with his hands, while the third person stood guard. When the prosecutrix started screaming, her family members came there and the persons holding her ran away. Thereafter, offence was registered against the applicants. 3. Learned counsel for the applicants submits that the applicants are innocent persons. They are falsely implicated the case. There are many contradictions and omissions in the statement of the prosecutrix. The FIR has been lodged after a delay of more than two days. Hence, it is prayed that the applicants be released on bail. 4. Learned Panel Lawyer for the State has vehemently opposed the bail application. 5. Heard learned counsel for the parties. 6. The age of the prosecutrix is below 18 years. The doctor found bite marks on the chest as well as abrasion all over the body of the prosecutrix. 7. There are sufficient evidence against the applicants showing their involvement in the crime. Hence, this Court is not inclined to grant bail to the applicants. 8. At this stage, learned counsel for the applicants prays for withdrawal of this application. 9. As this Court has already passed the above order in this case, the prayer made by learned counsel for the applicants for withdrawal of the application cannot be entertained, hence, is hereby rejected. 10. Accordingly, this M.Cr.C stands dismissed.
