JUDGMENT : HARSIMRAN SINGH SETHI, J. 1. Learned counsel for the petitioner states that though the petitioner has retired on attaining the age of superannuation on 31.10.2018, but still, his provident fund, for which he is entitled for has not been released and that too without any valid justification. 2. Learned counsel for the petitioner further states that there is no impediment for the release of the provident fund of the petitioner as there are no proceedings which are pending against the petitioner and even otherwise keeping in view the settled principle of law, the provident fund of the employee cannot be withheld by the respondents after the retirement. 3. The prayer of the petitioners is for issuance of directions to the respondents to release the provident fund of the petitioner forthwith alongwith interest. 4. Learned counsel for the petitioner states that for the relief, which is being claimed in the present writ petition, the petitioner has submitted a representation dated 24.05.2019 (Annexure P-3), which is still pending consideration with the respondent and the petitioners will be satisfied, at this stage, in case a time bound direction is issued to respondent No. 3 to decide the said representation and to pass an appropriate speaking order. 5. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondent No. 3 is directed to decide the representation dated 24.05.2019 (Annexure P-3) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case, it is found that the petitioner is entitled to any monetary benefits after the decision of the said representation, the same should also be paid to him within three months thereafter. 6. Present writ petition stands disposed of.
