JUDGMENT Shailendra Shukla, J. - Heard. Perused the case diary. 2. This is fourth application under Section 439 of Cr.P.C. for grant of bail. Applicant Jayshree W/o Shirish Soni is implicated in Crime No.46/2018 registered at Police Station Lasudiya, District Indore for the offence punishable under Sections 365, 120-B, 506/34, 386, 384, 343, 342 and 364-A of IPC and she is in custody since 20.12.2018. 3. Report had been called for as to whether there are any arrangements regarding keeping Covid-19 patients from other patients or not. 4. Today, report has been received in which it has been mentioned that there are separate arrangements for Covid-19 patients in terms of quarantine and isolation centres as well. 5. Learned counsel for the applicant submits that applicant suffers from Tuberculosis and HIV and she is in jail since 20.12.2018. It is submitted that trials are not proceeding before the Courts due to Covid Pandemic situation and therefore, bail be granted to the applicant. 6. Per contra, learned Public Prosecutor for the State has vehemently opposed the bail application submitting that applicant faces trial under very serious offences as aforementioned and her earlier bail applications have already been dismissed and there is no ground to grant her bail in such serious offences. 7. Learned counsel for the objector has submitted that if the applicant is granted bail, then life of the complainant would be endangered. 8. Considered. 9. It is not denying that due to Covid-19 Pandemic situation, trials are stalled since last five months before the Courts and it appears that for some more time, present situation will prevail as it is. In view of the above fact, it would be appropriate to grant temporary bail to the applicant for a period of 60 days. Without expressing any opinion on the merits of the case, prayer for grant of temporary bail is allowed and it is directed that the applicant - Jayshree shall be released on bail temporarily for a period of 60 (Sixty) days subject to her furnishing a bail bond of Rs.1,00,000/- (Rupees One lac only) with one local surety in the like amount to the satisfaction of the Trial Court/Committal Court and an undertaking that she will surrender before the concerned Court immediately after expiry of the aforesaid period from the date of her release.
It is further stipulated that applicant shall mark her presence before the concerned Police Station on Every Monday of the month between 10.00 AM to 12.00 PM. No further extension of time shall be granted to the applicant and during this period, for the sake of verification, it is being observed that incase applicant tries to influence or threaten any of the witnesses or indulges in likewise criminal activities, then this order granting bail shall stand cancelled without reference to this Court. Another condition is that applicant shall surrender her passport before the concerned Court at the time of furnishing the bail bond. 10. A copy of this order be sent to the Court concerned for compliance. 11. M.Cr.C. No.11172/2020 is allowed and stands disposed of. Certified copy as per rules.
