JUDGMENT B K Shrivastava, J. - Arguments heard on the application filed under Section 439 of Cr.P.C. on 14.09.2020 for grant of bail on behalf of applicant Santosh Kumar who is confined in custody since 5/09/2020 in connection with Crime No. 546/2020 registered at Police Station Balaghat, District Balaghat for offence punishable under Section 34 (2) of the M.P. Excise Act. 2. It appears from the record that total 54 bulk litres of liquor was seized from the possession of the applicant. 3. It is pointed out by the State on the basis of case diary that this is the first case registered against the applicant. There is no any criminal background of the applicant. 4. Therefore, looking to the aforesaid all circumstances and the present situation arising out from Covid-19, the application is allowed. It is directed that the applicant shall be released on bail on his furnishing a bail bond worth Rs. 30,000/- (Rupees Thirty Thousand only) and a personal bond of the same amount to the satisfaction of the trial Court. 5. It is directed that the applicant shall abide by the conditions as enumerated under section 437(3) of the Cr.P.C. 6. At the time of releasing from custody, all the instructions issued by the Government related to Covid-19 shall also be followed by the concerned authority. 7. This application stands allowed. 8. C.
