JUDGMENT Vivek Rusia, J. - This is a First application under Section 439 Cr.P.C. by applicant - Parsingh S/o Jairam Vakhla, who has been arrested by Police on 06.08.2020 in Crime No.793/2019, Police Station Jhabua, District Jhabua concerning offence under Sections 392 and 395 of the IPC. 2. Heard the learned counsel for the parties through video conferencing and perused the case diary. 3. As per prosecution story, on 22.08.2019, applicant along with four others found involved in the highway robbery. 4. Learned counsel for the applicant submits that he has been falsely implicated in this case. There is a recovery of only Rs.2,000/- cash and he has been made accused on the basis of memorandum under Section 27 of the Evidence Act. The investigation has been completed and challan has been filed. Applicant is in custody since 06.08.2020. The trial may take time to conclude it. Hence, the applicant be released on bail. 5. Learned Panel Lawyer opposes the prayer for grant of bail by submitting that there are as many as 5 criminal antecedents against the applicant. 6. Looking to the criminal past at present no case is made out for grant of bail. Accordingly, M.Cr.C. No.35211/20 is hereby dismissed.
