ORDER 1. This criminal revision has been filed against the judgement dated 7.9.2020 pronounced by the 4th ASJ, Shujalpur in Cr.A. No.74/2018 whereby learned Judge has partly maintained the judgement pronounced by the ACJM, Shujalpur in Criminal Case No.341/2016 vide its judgement dated 10.7.2018 and the applicant has been found guilty under section 323 of IPC by the appellate Court and he has been acquitted from other charges. 2. Learned counsel for the applicant has pointed out that compromise has been entered into between both parties and compromise application is in photocopy which is addressed to the High Court of M.P., Indore Bench. He was asked as to why original copy was not filed. He has informed that from Shujalpur to Indore, no conveyance is available and buses and trains are not functioning. 3. I.A. No.6386/2020, which is an application for suspension of jail sentence of the applicant is under consideration. The applicant is sent to jail on 22.9.2020. The compromise application is un-dated and is not supported with an affidavit as well. However, relying upon the word of counsel for the applicant, it would be appropriate to direct the complainant to appear before the JMFC, Shujalpur (Shri Dheeraj Kumar) on 3.10.2020 and only after receiving the verification of compromise, this Court shall suspend jail sentence of the applicant. List on 05.10.2020.
