JUDGMENT Anjuli Palo, J. - This is first application under Section 439 of Cr.P.C. for grant of bail filed on behalf of applicant-Ajay Chadhar who is in custody in connection with Crime No. 661/2020 registered at Police Station Banda, District Sagar for commission of offence under Sections 376 and 506 of the Indian Penal Code. The applicant is in custody since 05.09.2020. 2. Learned counsel for the applicant submits that the applicant is an innocent person. He has been falsely implicated in the case due to some property dispute between him and his brother. The prosecutrix is the wife of applicant's brother. It is also submitted that due to outbreak of Corona Virus pandemic, trial will take considerable time, hence it is prayed that applicant be released on bail. 3. Learned Panel Lawyer for the State has strongly opposed the bail application. 4. Learned counsel for the objector has filed affidavit of the complainant and submitted that she has no objection if the applicant is released on bail. 5. Considering the facts and circumstances of the case, without commenting upon the merits of the case, this application is allowed. 6. It is directed that applicant-Ajay Chadhar be released on bail on furnishing a personal bond in the sum of Rs. 30,000/- (Rupees Thirty Thousand only) with one solvent surety, in the like amount to the satisfaction of the concerned trial Court for his appearance on the dates so fixed by that Court during trial. 7. The applicant shall comply with the provisions of Section 437 (3) of the Cr.P.C. 8. Accordingly, the application is allowed and disposed of.
