JUDGMENT : Arun Bhansali, J. 1. Heard learned counsel for the parties. Perused the material available on record. 2. The present second bail application has been filed under Section 439 Cr.P.C. on behalf of the applicant, who is in custody in connection with FIR No. 89/2020, Police Station Panchu, District Bikaner, for the offences under Sections 498-A, 302/34 of IPC. 3. It is submitted by learned counsel for the applicant that the applicant is brother-in-law (Jeth) of the deceased, the bail application of the husband has already been accepted by this Court by order dated 22.10.2020 and while rejecting the first bail application, the Court has granted liberty to the applicant to approach the Court after statement of Smt. Gavri Devi was recorded. 4. It is submitted that out of all the statements as recorded under Section 161 of Cr.P.C., only Smt. Gavri Devi, who had made certain allegations against the applicant, however, in the statement recorded during the trial as P.W. 1, Smt. Gavri has turned hostile and in the cross-examination, she has not said anything which can implicate the applicant. 5. Further submissions have been made that in all the statements recorded under Section 161 Cr.P.C. omnibus allegations have been made including the fact that the deceased was mentally disturbed. The trial is likely to take time and the applicant is in judicial custody since 29.06.2020. 6. Learned Public Prosecutor opposed the bail application with reference to the post-mortem as well as the forensic science laboratory report pertaining to the viscera. 7. In the circumstances of the case, without expressing any opinion on the merits of the case, this Court is of the opinion that the second bail application filed by the applicant deserves to be accepted. 8. Consequently, the second bail application is allowed. It is ordered that the accused-applicant - Dularam S/o. Sh. Jairam, arrested in connection with FIR No. 89/2020, Police Station Panchu, District Bikaner, shall be released on bail; provided he furnish a personal bond of Rs.50,000/- (Rupees Fifty Thousand Only) with two sureties of Rs.25,000/- (Rupees Twenty Five Thousand Only) to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
