ORDER : 1. Delay of 45 days in preferring review petition is condoned. 2. Application for listing of review petition in open court is dismissed. 3. After considering the entirety of the matter including the substantial questions of law which arose for consideration, the High Court allowed the Second Appeal and restored the judgment and order passed by the Trial Court. 4. After hearing rival submissions in the matter, the view taken by the High Court was affirmed and the Special Leave Petition was dismissed. 5. The grounds taken in the Review Petition do not make out any error apparent on record to justify interference. 6. This Review Petition is, therefore, dismissed.
