JUDGMENT Avneesh Jhingan, J. - The matter is taken up for hearing through video conference due to COVID-19 situation. 2. This is a petition seeking anticipatory bail in case FIR No.139, dated 17th April, 2021, under Sections 323, 34, 406, 498-A and 506 IPC, registered at Police Station Civil Lines Hisar. 3. The FIR was a result of matrimonial dispute. While issuing notice of motion on 26th May, 2021, this Court directed the SHO/senior most officer of the concerned cell to conduct mediation proceedings and submit a report to this Court on or before the next date of hearing. The arrest of the petitioner was stayed. 4. Learned State counsel has filed a status report by way of an affidavit of Rajbir Singh, HPS, Deputy Superintendent of Police, Hisar-I through electronic medium. Print out of the same is taken on record. Para 3 of the status report is quoted below: "3. That in compliance of order dated 26.5.2021, it is submitted that the petitioner and respondent No.2 were called on 15.2.2021 by Incharge Women Cell, Hisar for mediation. During counselling petitioner Sunil Sharma stated that he wants to reside with his wife Pankaj @ Kanika (Respondent No.2). Similarly Pankaj @ Kanika (Respondent No.2) also stated that she is willing to reside with Sunil Sharma (petitioner) with some terms & conditions such as surety of her children, share in residential house and possession of istridhan etc. for which petitioner Sunil Sharma has agreed to fulfil the demands of Respondent No.2. As per counselling petitioner and respondent No.2 have agreed to live with each other." 5. In view of the fact that the matter has been compromised and the parties have bridged their differences, the petitioner is granted anticipatory bail subject to his joining investigation within two weeks. In the event of arrest, he shall be released on bail subject to his furnishing adequate bail bonds to the satisfaction of the Investigating Officer. He is directed to join investigation as and when called for. He shall abide by the conditions as envisaged under Section 438 (2) Cr.P.C. 6. The petition is allowed. 7. In case of failure of the petitioner to join the investigation, the State would be at liberty to file an application for recalling of this order.
