JUDGMENT : 1. The present writ petition has been filed for quashing the order dated 11.02.2021 communicated vide memo No. 145 dated 12.02.2021 (Annexure-4 to the writ petition) issued by the respondent No.4 whereby one Sudama Prasad, Co-operative Extension Officer working in the office of the respondent No.5, has been appointed as Supervisor for convening the General Body meeting of the members of the Bharat Ekta Grih Nirman Sahyog Samiti Limited, Bandhgoda, Chas, Bokaro for constituting ad hoc Board so as to conduct the election of the said society which according to the petitioner, is without jurisdiction as the said power can only be exercised by the respondent No.3. A counter affidavit has been filed on behalf of the State-respondents raising a preliminary objection with regard to maintainability of the present writ petition on the ground that the petitioner has got alternative/efficacious/statutory remedy of preferring an application under Section 48 of the Bihar (now Jharkhand) Co-operative Societies, Act, 1935 (hereinafter referred to as ‘the Act, 1935’) before the respondent No.3 against the impugned order dated 11.02.2021. 2. Having heard learned counsel for the parties and keeping in view that the petitioner has got alternative/efficacious/statutory remedy of preferring an application under Section 48 of the Act, 1935 before the respondent No.3 against the impugned order dated 11.02.2021, I am not inclined to entertain the present writ petition at this stage and the same is accordingly dismissed as not maintainable. 3. The petitioner is however at liberty to take alternative/efficacious/statutory recourse as available under law.
