Judgment Mr. Amol Rattan Singh, J. (Oral):- Case heard by way of video conferencing. 2. By this petition, filed under the provisions of Section 439 of the Cr.P.C, the petitioner seeks the concession of regular bail, upon FIR no.59, dated 08.03.2021, having been registered at Police Station City, Sri Muktsar Sahib, alleging therein the commission of an offence punishable under Section 306 of the IPC. 3. Learned counsel for the petitioner submits that the petitioner is the brother-in-law of the wife of the deceased Amrinder Singh, who committed suicide allegedly on account of harassment by his wife and the petitioner and the brother of his wife. 4. He submits that as a matter of fact there was no allegation of any instigation to commit suicide against the petitioner and therefore he having been in custody more than three months, he deserves to be admitted to bail. 5. Mr. Girdhar, learned counsel appearing for the complainant, on the other hand submits that the petitioner having specifically been named in the suicide note left behind by the deceased, as one of the three persons who were continuously harassing him and insulting him, due to which he committed suicide, he does not deserve to be admitted to bail. 6. Learned State counsel reiterates the same. 7. Having considered the matter, in view of the fact that there is no direct instigation to commit suicide shown at least at this stage to this court, and also keeping in view the fact that the petitioner has been in custody for more than three months, without making any comment on the actual merits of the case, this petition is allowed, with the petitioner directed to be enlarged on bail, upon his furnishing adequate bail and surety bonds to the satisfaction of the trial court.
