JUDGMENT M S Jawalkar, J. - Heard Mr. V.R. Tamba along with Mr. Vaman Gaonkar, learned Counsel for the petitioners, Mr. Pravin Faldessai, learned Additional Public Prosecutor for respondent no.1 and Mr. A.D. Bhobe, learned Counsel for respondents no.2 & 11. 2. Rule. Rule made returnable forthwith. By consent and at the request of the learned Counsel appearing for the parties, petition is disposed of at the admission stage. Learned Counsel appearing for the respective respondents waive service. 3. By above petitions, the petitioners have prayed for a limited relief to set aside the roznama order dated 28.11.2019, passed by the Deputy Collector and SDO, Sattari, Valpoi-Goa, which is passed without deciding the application of the petitioners raising preliminary objection on maintainability. 4. In my considered opinion, the application raising maintainability and for quashing the present proceedings is required to be heard before passing the order of directing inquiry in the matter, so also, before directing to file written reply/status of the possession of law, etc. 5. The learned Advocate Mr. Pravin Faldessai, fairly conceded that if such directions are given to the Deputy Collector and SDO, Sattari, Valpoi - Goa, he will decide the application first. There is no objection to respondents no.2 & 11 for issuance of such direction. 6. Accordingly, I proceed to pass the following order: ORDER (i) Criminal Writ Petitions are allowed. (ii) Roznama order dated 28.11.2019, passed by the Deputy Collector and SDO, Sattari, Valpoi-Goa, is hereby quashed and set aside. (iii) The learned Deputy Collector and SDO, Sattari, Valpoi-Goa, is further directed to decide the application on maintainability of the proceedings filed by present petitioners and then to proceed further in the matter. (iii) All rights and contentions of the parties are expressly kept open. (iv) Rule is made absolute in the above terms. All Concerned to act on the basis of an authenticated copy of this order.
