ORDER : 1. The present writ petition has been filed for issuance of direction upon the respondents to reimburse the amount as per the Insurance Policy to the petitioner on account of theft of Excavatory Soil Vibratory Compactor. 2. At the very outset, Mr. Manish Kumar, learned counsel appearing on behalf of the respondent no. 3 the New India Assurance Company Limited raises a preliminary objection with regard to the maintainability of the writ petition on the ground that the petitioner has an efficacious remedy of filing a complaint before the District Consumer Forum. 3. Having heard learned counsel for the parties and keeping in view that the petitioner has an efficacious remedy of preferring a complaint before the District Consumer Forum agitating his grievance against the respondent no. 3 regarding non-payment of claim as per the concerned Insurance Policy, I am not inclined to entertain the writ petition. The same is accordingly dismissed as not maintainable. The petitioner is, however, at liberty to take appropriate recourse in the matter before the District Consumer Forum as available under law.
