JUDGMENT Tejinder Singh Dhindsa, J. - Matter has been taken up through Video Conferencing via Webex facility in the light of the Pandemic Covid-19 situation and as per instructions. 2. Petitioner seeks benefit of regular bail pending trial in case FIR No.09, dated 25.01.2021, under Sections 363/366-A IPC registered at Police Station Division No.1, District Jalandhar. 3. Counsel for the parties have been heard. 4. Fir came to be registered on the statement of Gurnam Singh i.e. father of the victim. As per complainant, victim's date of birth is 19.08.2006. On 25.01.2021 at about 8:30 A.M., she had gone to school but did not return home after school hours. Complainant asserted that some unknown persons have enticed the victim with the intention to marry her. Subsequently on 26.01.2021, complainant got recorded his supplementary statement that he had received a telephone call from his relative, namely, Tarlochan Singh, who in turn had informed that it was the present petitioner who had enticed his daughter with the intention to marry. 5. During the course of arguments, it has gone uncontroverted that in the statement of the prosecutrix recorded under Section 164 Cr.P.C., she had clearly stated that she had never been enticed away by the petitioner herein. Furthermore, no medical of the prosecutrix was got conducted as she had refused the same. 6. There are no allegations of the petitioner having subjected the victim to sexual abuse. 7. Petitioner was arrested on 27.01.2021. 8. Investigation in the case is complete and the challan already stands presented. 9. Charges till date have not been framed. Trial, as such, would take time to conclude particularly keeping in view the current Covid pandemic. 10. In view of the above and without making any observations on the merits of the case, petitioner is held entitled to the benefit of bail. 11. Petitioner be enlarged on bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate, concerned. 12. Disposed of.
