JUDGMENT 1. This bail application has been filed under Section 439 Cr.P.C. in connection with FIR No.26/2017 registered at Police Station, Chittorgarh District Chittorgarh for offence under Section(s) 363, 366 of IPC and section 3/4 of POCSO Act and in alternate offence under Section 376(2)(I) of IPC. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the entire material available on record. 3. Learned counsel for the petitioner submits that the petitioner after having been granted bail had left the place as he is basically nomads and has been arrested for jumping bail. 4. Learned Public Prosecutor has opposed the bail application. I have considered the submissions. 5. Taking into consideration the overall aspects and that the petitioner was granted bail earlier and looking into his age, but without commenting further on merits of the case, I deem it just and proper to enlarge the petitioner on bail. 6. Therefore, this bail application is allowed and it is ordered that the accused petitioner - Dilip Kanjar S/o Shri Babu Lal Kanjar, be released on bail under Section 439 Cr.P.C. in connection with aforesaid FIR provided the petitioner furnishes a personal bond of Rs.20,000/- with one surety in the like amount to the satisfaction of the concerned Magistrate with the stipulation that he shall comply with all the conditions laid down under Section 437(3) Cr.P.C.
