JUDGMENT 1. Heard learned Counsel for the parties. 2. The present application has been taken out by M/s. M.K. Aromatics Ltd. seeking for extension of time for commissioning of the post consumer waste plastic to fuel plant at Pernem up to 15.05.2020. 3. Today, we are on 28.09.2021. Therefore, the relief in this application has already been rendered infructuous. 4. According to Mr. Desai, learned Senior Counsel for the applicant, the plant is complete and has been commissioned. 5. However, Ms. Sapna Mordekar, learned Additional Government Advocate for the State and GSUDA disputes this position. 6. Ms. Mordekar states that an expert agency is to be appointed to go into the issue of whether this plant is completed and capable of being commissioned or not. Mr. Desai points out that consent to operate has already been issued by the Goa State Pollution Control Board. 7. According to us, we are not required to go into this issue on this statement because the relief in this application has already been rendered infructuous. 8. Accordingly, this application is disposed of. 9. However, in the main matter, the GSUDA should file an affidavit by 22.10.2021, reporting to us whether the plant is complete and has been commissioned and is functioning or not.
