JUDGMENT 1. The present bail applications have been filed under Section 439 Cr.P.C. The petitioners have been arrested in connection with FIR No.581/2020 registered at Police Station Kanota, District Jaipur City (East) for the offence(s) under Section 143, 323, 341, 427, 451, 380, 354, 504 & 452 of I.P.C. and later on for the offence under Sections 143, 323, 341, 427, 451, 380, 354, 504 & 452, 308 & 459 of I.P.C. against petitioners Lokesh Gurjar & Rahul Singh and under Sections 147, 148, 149, 323, 341, 325, 427, 380, 354, 308 & 459 of I.P.C. against petitioners Chetan Prakash Meena, Ramesh Chand Meena @ Tinku & Hari Lal Meena @ Harlal. 2. Learned counsels for the petitioners submitted that it is a case of version and cross-version in which persons from both sides have received injuries. They submitted that the petitioners are in custody since 11.07.2021, investigation as against them is complete, they have no criminal antecedents except accused Rahul against whom an FIR under Sections 498-A & 406 I.P.C. has been registered and accused Ramesh Chand Meena against whom a criminal case under Sections 323 & 341 I.P.C. is pending and prayed for their release on bail. 3. Learned Public Prosecutor has opposed the bail applications. Taking into consideration the submissions advanced by learned counsel for the petitioners, the nature of allegations against them, their length of custody, material contained in the case diary and absence of criminal antecedents of similar nature; but, without expressing any opinion on the merits of the case, this Court deems it just and proper to enlarge the petitioners on bail. 4. Accordingly, the bail applications are allowed and it is directed that accused-petitioners 1. Lokesh Gurjar S/o Shri Satyanarayan Gurjar, 2. Rahul Singh S/o Om Prakash Singh, 3. Chetan Prakash Meena S/o Shri Yugal Kishore, 4. Ramesh Chand Meena @ Tinku S/o Late Shri Bhagchand Meena & 5. Hari Lal Meena @ Harlal S/o Mathuriya Meena shall be released on bail under Section 439 Cr.P.C. in connection with afore-mentioned FIR registered at concerned Police Station, provided each of them shall furnish a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that they shall comply with all the conditions laid down under Section 437(3) Cr.P.C.
