JUDGMENT Avneesh Jhingan, J. - The matter is taken up for hearing through video conference due to COVID-19 situation. 2. This is a petition for grant of anticipatory bail in case of FIR No.307 dated 29.7.2019, under Sections 406, 420 IPC, registered at Police Station Urban Estate Rohtak, District Rohtak, later on added Sections 467, 468, 471, 120-B IPC. 3. As per the allegations, there was a dispute among the family members regarding distribution of compensation of land acquired. The petitioners were granted interim bail vide order dated 26.2.2020 of Additional Sessions Judge, Rohtak,. During investigation, Sections 467, 468, 471, 120-B IPC were added, thereafter, the bail was cancelled. 4. Learned counsel for the petitioners submits that parties have compromised the matter. 5. Learned counsel for the complainant supports the factum of compromise. 6. In the present case, co-accused Ram Chander was granted anticipatory bail by this Court on 4.8.2020 (CRM-M-12777 of 2020). It is not a case where recovery is to be effected. 7. Considering that co-accused has been granted anticipatory bail by this Court, the matter has been compromised and no recovery is to be made from the petitioners, the petitioners are granted pre-arrest bail subject to their joining the investigation within two weeks. In the event of arrest, they shall be released on bail subject to their furnishing adequate bail bonds to the satisfaction of the investigating officer. They are directed to join investigation as and when called for. They shall be bound by the conditions as envisaged under Section 438(2) Cr.P.C. 8. The petition is allowed. 9. It is clarified that the observations made hereinabove shall not be construed as an expression of opinion on the merits of the case. 10. In case of failure of the petitioners to join the investigation, the State would be at liberty to file an application for recalling of this order.
