JUDGMENT Gurvinder Singh Gill, J. (Oral). - The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered against him vide FIR No.54, dated 11.8.2019, Police Station Kacha Pacca, District Tarn Taran, under Sections 420, 120-B IPC. 2. At the time of issuance of notice of motion the following order was passed: “It is contended by learned counsel for the petitioner that the allegation against the petitioner is that the petitioner alongwith his brother Jaspal Singh had opened an office for arranging for sending the people abroad and in the process, they have taken around Rs.25,46,000/- from the complainant and other persons. However, the petitioner is residing separately and is running a shop of agriculture implements at a different place than the alleged office, which is stated to be in the house of Jaspal Singh only. Still further, it is submitted that there is no allegation that the petitioner has directly accepted the money from the complainant or any other person. Notice of motion for 16.03.2020. Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds/surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) Cr.P.C.” 3. The learned State counsel, upon instructions from SI Kulwant Singh, has informed that pursuant to interim directions issued by this Court, the petitioner has since joined investigation and that his custodial interrogation is not required and he is not wanted in any other case. 4. In view of the aforestated position, the petition is accepted and the interim directions issued by this Court vide order dated 24.10.2019 are hereby made absolute subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
