Judgment Mr. Avneesh Jhingan, J. (Oral):- The matter is taken up for hearing through video conference due to COVID-19 situation. 2. This petition is filed for grant of regular bail in case of FIR No.75 dated 11.4.2021, under Sections 21, 21 (B) of NDPS Act, registered at Police Station City-1, Abohar, District Fazilka. 3. On 11.4.2021, the police acting upon an information received, apprehended petitioner and 20 grams of Heroin was recovered from the glove box of Car bearing registration No.UP-16-K-1490. The car was being driven by Kulwinder Singh @ Kinda (petitioner). 4. Learned counsel for the petitioner submits that the recovery is of non-commercial quantity; investigation is complete and challan stands presented. He further submits that the petitioner is involved in three more cases but the recovery in those cases was of non-commercial quantity and the petitioner is on bail in all cases. His contention is that the petitioner is a drug addict. 5. Learned State counsel opposes the prayer for grant of regular bail and on instructions from ASI Mukhtiar Singh submits that the petitioner has criminal antecedents and is involved in three more FIRs. 6. Considering the quantity of Heroin recovered and the fact that the investigation is complete; no recovery is to be made; conclusion of trial is likely to take time; the petitioner is on bail in all other FIRs, the petitioner is granted bail on furnishing bail/surety bonds to the satisfaction of the Chief Judicial Magistrate/ Duty Magistrate concerned. 7. The petition is allowed. 8. It is clarified that the observations made hereinabove shall not be construed as an expression of opinion on the merits of the case.
