JUDGMENT Anil Kshetarpal, J. (Oral) - On 22.12.2020, the following order was passed:- "On 18.12.2020, the following order was passed: - "Hearing of the case was held through video conferencing on account of restricted functioning of the Courts. Learned counsel for the petitioners contends that without issuing any recruitment notice, a web portal for registration of Sports and School Special Assistant was opened and closed within few hours. He submits that the hard copy submitted by the petitioners has not been considered. Ms. Shruti Jain Goyal, Deputy Advocate General, Haryana, prays for a short adjournment to take complete instructions and assist. Adjourned to 22.12.2020. To be listed in urgent." A short reply to the writ petition has been filed by Mr. Nitin Kumar Yadav, Director General, Elementary Education, Haryana. On a Court question as to how and in what manner public notice regarding decision of the competent authority to issue recruitment notice was issued, Ms. Shruti Jain Goyal, Deputy Advocate General, Haryana has failed to draw attention of the Court to the same. A large number of posts of Sports and School Special Assistant on contractual basis are sought to be filled in. In absence of public notice through any medium, the Government or its agencies can not offer and give employment using public funds. Keeping in view the aforesaid facts, the State of Haryana is restrained from making appointment on the basis of the applications registered on a web portal which is alleged to have been opened only for a few hours without prior notice having been circulated ensuring that the information reaches everyone interested. Let the Additional Chief Secretary, Government of Haryana, School Education Department file affidavit as to how and in what manner, the necessary information with regard to decision to invite applications for filling up the posts of Sports and School Special Assistant was sought to be communicated amongst the public at large before throwing open the web portal. List on 15.01.2021" 2. Ms. Shruti Jain, DAG, Haryana, states that the Department has taken a decision to invite the applications for filling up the post of Sports and School Special Assistant, after issuing the public notice. She submits that due publicity shall be given, enabling the interested candidates to apply. 3. Keeping in view the aforesaid facts, the writ petition is rendered infructuous and is, therefore, disposed of as such. 4.
