JUDGMENT Avneesh Jhingan, J. - The matter is taken up for hearing through video conference due to COVID-19 situation. 2. This is a petition seeking regular bail in case of FIR No.49 dated 8.5.2021 under Sections 363, 366, 323, 341, 346, 120-B IPC, registered at Police Station Sadar Jagraon, District Ludhiana Rural. 3. The complainant in the FIR alleged that her daughter who was doing IELETS was being harassed by Gurmaninder Singh (accused) for marrying her. The talks for marriage did not materialized. Marriage of daughter of complainant was fixed with NRI boy, thereafter accused started humiliating her daughter. On 7.5.2021, the complainant and her daughter were going to Gurudwara and on the way accused came on car. His cousin was sitting on the front seat and there was three occupants in the car. The accused along with his cousin dragged the daughter of the complainant. When the son of the complainant tried to save his sister, was given dah blow on his head. During the course of investigation, the daughter of the complainant in her statement named petitioner stating that he was present on the spot and was the pillion rider on a motor cycle belonging to the accused driven by Karamandeep Singh @ Karman. 4. Learned counsel for the petitioner submits that it is a case of false implication. No specific role has been attributed to the petitioner. The petitioner was named in the supplementary statement. Reliance is placed on the fact that co-accused was granted bail by this Court. 5. Learned State counsel on instructions from ASI Surjit Singh opposes the prayer for grant of regular bail. 6. The petitioner is in custody since 19.6.2021. No overt act is attributed to the petitioner. The only allegation is that he was there at the time of incident. No recovery is to be made from the petitioner. Completion of investigation and conclusion of trial is likely to take time. Bail is granted to the petitioner on furnishing surety bonds to the satisfaction of the Chief Judicial Magistrate/ Duty Magistrate concerned. 7. The petition is allowed. 8. It is clarified that the observations made hereinabove shall not be construed as an expression of opinion on the merits of the case.
