JUDGMENT Manish Pitale, J. - By this application, the applicant is challenging the concurrent findings rendered by the two courts below in proceedings initiated by the respondent under Section 138 of the Negotiable Instruments Act, 1881. 2. The Magistrate convicted the applicant under the aforesaid provisions and sentenced him till rising of the Court further directing the applicant to pay compensation of Rs.75,813/- and in default of which the applicant was directed to undergo simple imprisonment for a period of three months. The appeal filed by the applicant was dismissed by the Sessions Court and it was directed that the applicant shall be taken into custody. 3. Accordingly, the applicant was taken into custody on 25. 11.2021. It is brought to the notice of this Court that the applicant has today deposited the entire amount of Rs.75,813/- with the respondent and a copy of the receipt is handed over along with memo. The same is taken on record. It is informed that the respondent was given private notice by the learned counsel appearing for the applicant about listing of the application today. 4. Since short point is involved in the present application, issue notice for final disposal returnable on 20.1.2022.
