Judgment Mr. Avneesh Jhingan, J.(Oral):- The matter is taken up for hearing through video conference due to COVID-19 situation. 2. This petition under Section 439 Cr.P.C is filed seeking regular bail in FIR No. 317, dated 23rd May, 2021, under Section 379-A read with Section 34 IPC registered at Police Station Chandnibagh, District Panipat. 3. FIR was at the instance of Satyender Kumar. As per the allegations, on 22nd March, 2021 two boys snatched the mobile from the complainant near Mittal Mega Mall. Accused Dilshad was arrested, he got recovered two snatched mobile phone. The name of the petitioner was surfaced in a disclosure statement by co-accused. There is recovery of mobile phone from the petitioner also. 4. Learned counsel for the petitioner submits that petitioner is running a small mobile repair shop. The co-accused had sold the said mobile to him. He is a 19 year young boy, having no criminal antecedents. The investigation is complete. 5. Learned State counsel opposes the prayer for grant of bail. 6. Name of the petitioner surfaced in a disclosure statement. He is not involved in any other criminal case. The investigation is complete. The challan stands presented. The conclusion of trial is likely to take time. Petitioner is granted bail subject to his furnishing adequate bail bonds to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate concerned. 7. The petition is allowed. 8. However, it is clarified that any observation made hereinabove, shall not be construed as an expression of opinion on the merits of the case.
