JUDGMENT 1. Heard learned Counsel for the parties. 2. By this petition, the petitioner seeks the following substantive relief : A. For a writ of mandamus or any other writ, direction or order in the nature of mandamus, inter alia, directing the respondent no.2 to take a decision regarding the petitioner's application dated 15.06.2021 for consent to operate his catering unit and communicate the same to the petitioner within such time as this Hon'ble Court may deem fit to grant. 3. Perused the papers. Vide order dated 16.03.2021, passed by this Court in Writ Petition No.28 of 2021 (Coram : M.S. Sonak & M.S. Jawalkar, JJ.), the petitioner was restrained from undertaking any activities of catering through the suit premises until he obtained a consent to operate from the GSPCB, i.e. respondent no.2 herein or until GSPCB certifies that such consent is unnecessary. In para 9 of the order it is further stated that if the decision of the GSPCB is in favour of the petitioner (original respondent no.14 in Writ Petition No.28 of 2021) then the same should not be implemented for a period of 15 days from the date of its communication to the petitioner in Writ Petition No.28 of 2021. 4. The grievance of the petitioner is that the respondent no.2, i.e. GSPCB has not taken a decision on the petitioner's application dated 15.06.2021, seeking consent to operate his catering unit. 5. Learned Counsel appearing for the respondent no.2 states that an appropriate decision will be taken on the petitioner's application dated 15.06.2021 by the respondent no.2 - Authority within two weeks from today. Statement is accepted. On decision being taken the same be communicated to the petitioner herein. 6. Petition is disposed of on the aforesaid terms. It is made clear that we have not gone into the merits of the petition. 7. All parties to act on the authenticated copy of this order.
