JUDGMENT Dinesh Mehta, J. - By way of the present writ petition, the petitioner has challenged the order dated 4.1.2021 whereby he has been transferred to Government Senior Secondary School, Keduli. 2. It is the specific case of the petitioner that he is a Lecturer in History and there is no vacant post in the school, where he has been transferred. In support of his contention aforesaid, the petitioner has placed on record communication dated 13.1.2021 issued by the Principal of the said School indicating that there is no vacant post of Lecturer in History. 3. A reply to the writ petition has been filed by the State wherein factum of the post not being vacant in the Government Senior Secondary School, Keduli, has been admitted. 4. In this view of the matter, the petitioner's transfer vide impugned order dated 4.1.2021 is clearly contrary to facts and law; the same is hereby quashed. 5. As a consequence thereof relieving order dated 9.1.2021 whereby petitioner has been relieved to join at Government Senior Secondary School, Keduli is also quashed: 5. Needless to observe that the State shall be free to pass fresh transfer order, if deemed necessary. 6. The petition stands allowed as indicated above. 7. The stay application also stands disposed of accordingly.
