JUDGMENT 1. Heard the learned counsel for the parties. 2. The learned counsel for the Applicant states that by bare perusal of the F.I.R. and the statements stated to have been made by the complainant, offence under section 295A of the IPC is not made out. 3. The learned Counsel appears on behalf of the Respondent No.2/Complainant and seeks time. 4. Stand over to 25 January 2022. 5. The learned counsel for the Applicant states that the Applicant apprehends arrest in the light of notice received by the Applicant under section 41A of the Code of Criminal Procedure. 6. The learned Public Prosecutor, on instructions of the Investigating officer, states that no coercive steps will be taken against the Petitioner till the next date, however, the Applicant should co-operate with the investigation. The learned counsel for the Applicant states that the Applicant will co-operate with the investigation and attend the concerned police station on 22 December 2021. The statement is accepted. 7. We record and accept the statement made by the learned Public Prosecutor, on instructions, that no coercive steps will be taken against the Applicant till next date.
