Judgment Mr. Avneesh Jhingan, J.(Oral):- This petition under Section 439 Cr.P.C is filed seeking regular bail in FIR No. 36, dated 3rd March, 2021, under Sections 21(C)/25 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as ‘Act’), Section 29 of the Act added later on, registered at Police Station STF, SAS Nagar, Mohali. 2. The brief facts of the case are that police acting upon a secret information on 3rd March, 2021 checked the Activa bearing registration No. PB-02-DB-7231. The vehicle was driven by Deepak Kataria. 500 gram of Heroin was recovered from the vehicle. During investigation it revealed that Heroin was being supplied by Amanpreet Singh @ Rinka who is behind the bars and on his instructions, Navdeep Singh @ Navdeep @ Shera arranged the Heroine. 3. Learned counsel for the petitioner submits that the petitioner was not apprehended from the spot and no recovery is made from the petitioner. The investigation is complete and the petitioner is in custody since 7th June, 2021. 4. Learned State counsel opposes the prayer for grant of bail. She submits that petitioner is involved in three more cases, one of which is under NDPS Act. The recovery was of 600 grams charas in that case. 5. The name of the petitioner surfaced in the disclosure statement. No recovery was made from the petitioner. The investigation of the case is complete and challan stands presented. The conclusion of trial is likely to take time. The mere involvement of the petitioner in another NDPS case where there was a recovery of non-commercial quantity would not be a ground for denying him bail. The petitioner is granted bail on furnishing surety bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate concerned. 6. The petition is allowed. 7. It is clarified that the observations made hereinabove shall not be construed as an expression of opinion on the merits of the case.
