JUDGMENT Rameshwar Vyas, J. - Heard learned counsel for the appellant applicant, learned Public Prosecutor and perused the material available on record. 2. After going through the evidence recorded at the trial, there is specific allegation of PW-1 Deepa Ram and other prosecution witnesses that the appellant Ramesh inflicted the fatal lathi blow on the head of Nawa Ram, who was aged 75 years. The lathi blow resulted into fracture of frontal and temporal bone, causing injuries upon brain, which resulted to the death of the old man. 3. In this background, we are not inclined to suspend the sentences awarded to the appellant applicant. 4. Accordingly, the application for suspension of sentences is hereby rejected as being devoid of any merit. 5. The appeal shall be listed for hearing in the appropriate order of priority.
