JUDGMENT Prakash D. Naik, J. - Issue notice to the respondent. Learned A.P.P. waives service for respondent - State. 2. Learned Advocate Mr. S.C.Bhosle submits that he has instructions to represent the original complainant. He would file application seeking permission to assist the A.P.P. 3. The applicant is 75 years old person. The case of the prosecution is that, Regular Civil Suit No. 86/2012 was filed. There was compromise between the parties. It was agreed that all the members of joint family have share in the property of Tulshiram Monde. The accused prepared false and forged death certificate of Tulshiram and shown the same to be issued by Barhali Grampanchayat. Tulshiram had died on 17.05.1984. The accused had forged document and mutated the property in their name and sold entire property of deceased Tulshiram to the exclusion of other members of joint family. 4. Considering the age of the applicant and the factual aspect of the matter, presently interim protection can be granted to the applicant subject to hearing both the sides on receipt of investigation papers. Hence, the following order. ORDER (i) In the event of arrest of the applicant in Crime No.450/2019 registered with Shivajinagar Police Station, Nanded, the applicant be released on bail on executing P.R. bond in the sum of Rs. 25,000/-with one or more sureties in the like amount. (ii) This interim protection shall be in operation till next date. (iii) Stand over to 13th January 2022.
