JUDGMENT 1. Heard learned Senior Counsel for the petitioners. 2. The grievance of the petitioners in the aforesaid petition is that the Government, instead of regularising the petitioners' services as government primary teachers, having worked for more than 10 to 15 years, has invited applications by an advertisement dated 01/12/2021 for filling up 142 vacancies in the post of Government Primary School Teacher. 3. Learned Senior Counsel for the petitioners submits that the said advertisement is in complete disregard to the legitimate claim of the petitioners for being appointed as Government Primary School Teachers. Learned Senior Counsel has tendered a list giving detailed classification of the petitioners i.e. those who possess educational qualification and would be eligible as on 01/12/2021. The same is take on record. He submits that out of 67 petitioners, 57 could be eligible to file their applications pursuant the advertisement so issued; whereas, 10 would not be eligible having crossed the age limit, despite having the requisite educational qualifications. 4. Learned Advocate General, on instructions, states that those 57 candidates who are eligible, can file on-line application forms to the said posts and the balance 10 candidates who are not eligible, without prejudice, can file their applications in physical form. Learned Advocate General further states that the written examinations will be held only after 5th January 2022. Statements accepted. 5. Issue notice to the respondents, returnable on 3rd January 2022. 6. Learned Addl. Government Advocate waives notice on behalf of respondents No.1 and 2. Mr. Faldessai waives notice on behalf of respondent No.3. 7. Reply, if any, to be filed in the Registry before the next date. 8. All parties to act on an authenticated copy of this order.
