JUDGMENT 1. Heard learned Counsel for the parties. 2. The grievance of the petitioner in the aforesaid petition is, that despite making complaints to the Sarpanch of the Village Panchayat St. Lawrence on 27/1/2021, 15/2/2021 and 11/5/2021, as against Maria Fernandes and Agnelo Fernandes with respect to the alleged illegal construction and encroachment in the building, namely, Shaikh Plaza, situated in the property bearing Survey No. 67/5 and 67/6 of Agassaim Village, Tiswadi Taluka, no cognizance has been taken of the said complaints by the Sarpanch. 3. The Secretary, Village Panchayat, Agassaim is present in person. Learned Counsel for respondent No. 3, on instructions of the Secretary, states that respondent No. 3 will take a call on the said complaints made by the petitioner within two weeks from today. Statement accepted. 4. In view of the aforesaid, nothing survives for further consideration in the petition. 5. The petition stands disposed of on the aforesaid terms. Needless to state that if cognizance of the said complaints is taken, the respondent No. 3 will take steps thereafter, in accordance with law. 6. It is made clear that we have not gone into the merits of the petition/allegations made in the petition and as such, all contentions of all parties are kept open with respect to the subject-construction. 7. All parties to act on an authenticated copy of this order.
