JUDGMENT Sandipkumar C. More, J. - Heard learned a. P. P. as well as learned Counsel for the petitioner. 2 The present petition is fled by the petitioner, who is father of missing lady Mayuri Bhagwan Choudhary, who is missing since 10th august, 2021 as per the missing report lodged by her husband Balaji Vyankat Mhaske with M.I.D.C. Police Station, Walluj, aurangabad. 3 Today, a.S.I. Mr. V. N. Jiwade, attached to M.I.D.C. Police Station, Waluj and Lady Police Constable Smt. Rekha Laxman Chande brought missing lady Mayuri before me at about 02.30 p.m. The learned a. P. P. also seeks leave to produce on record statements of missing lady Mayuri Bhagwan Choudhary and Respondent No.3 Ratan Subhash Choudhary along with the report of a.S.I., M.I.D.C. Police Station, Waluj. He also seeks to produce copy of aadhar Card of missing lady Mayuri. 4 The aforesaid statements along with copy of aadhar card of missing lady Mayuri along with the report of a.S.I., M.I.D.C. Police Station, Waluj, are allowed to be placed on record. 5 On interrogation with missing lady Mayuri, she stated that though she is married to one Balaji Vyankat Mhaske on 27.06.2021, but Balaji, after marriage, started beating her. She further stated that since, before her marriage, she was in love with present Respondent No.3-Ratan Choudhary and even during subsistence of her marriage with Balaji Vyankat Mhaske, she, on her own will, started residing with Respondent No.3-Ratan at Mouza aran, Tahsil Madha, District Solapur. 6 It appears that the date of birth of missing lady Mayuri is 01.01.2001 as per the copy of the aadhar Card, which the petitioner himself has produced on record. Thus, missing lady Mayuri has attained majority and she herself stated that she wants to reside with Respondent No.3-Ratan Subhash Choudhary even during subsistence of her marriage with Balaji Vyankat Mhaske. On asking, whether there was any undue pressure on her, she stated in the negative. Though it appears that missing lady is married to one Balaji Vyankat Mhaske, but considering the fact that she is major, she can take decision where to reside as per her own wish. 7 Considering all these aspects, missing lady Mayuri Bhagwan Choudhary, brought by a. S. I. Rekha Laxman Chande, shall be at liberty to reside at any suitable place according to her own choice. 8 Stand over to 03rd January, 2022, for further orders.
