JUDGMENT 1. The Petitioners Bhaskar Shashank Sarkar and Dipankar Shashank Sarkar are the sons of of one Uma Shashank Sarkar who is a senior citizen aged 71 years and has been missing from her home at 113/a, Sainath apartment, Kasarvadavli, Thane, since 13 th February, 2021. 2. The Petitioners have filed the present Writ Petition seeking directions against Respondent No.1 State of Maharashtra through Senior Inspector of Police, Kasarvadavli Police Station and Respondent No.2 Kherwadi Police Station, Bandra East, Mumbai 400 051, to produce the Petitioners' mother before this Court within such period as this Court may deem fit and proper. 3. This is a shocking case of Police insensitivity in view of the following facts : 3.1 On 13th February, 2021, an old lady who is a senior citizen named Uma Shashank Sarkar, 71 years, suffering from alzheimers (dementia) went missing from her home at 113/a, Sainath apartment, Kasarvadavli, Thane. 3.2 Her sons the Petitioners abovenamed gave a missing persons complaint at Kasarvadavli Police Station, Thane on 14th February, 2021. 3.3 The said lady was found at Kherwadi area on 16th February, 2021 and was brought to the Kherwadi Police Station. 3.4 The said lady was kept at the Kherwadi Police Station from 10.00 a.m. and we are informed that by 8.00 p.m. she had left the Police Station on her own. 3.5 During the ten hours that she spent at the Police Station, the said lady was examined by a Doctor at the Police Station. The officials of the Police Station were aware that the said lady was unable to provide her address to the Police authorities, since according to the Police, she was uttering the words, 'air India' (being an ex-employee of air-India) and it was therefore evident that she was suffering from loss of memory. 3.6 The Officials at the Police Station who were aware that the said lady is suffering from dementia, instead of taking utmost care of her whilst she was in their custody, did not pay attention to her movements because of which she left the Police Station. This negligent attitude on the part of the Police is unpardonable. 4.

Though we are told that the officials of the Police Station immediately realized that she had left the Police Station, we fail to understand as to why the Police Officials were not in a position to immediately trace the whereabouts of the said lady who was not only a senior citizen, but was also in a frail and undernourished condition. We therefore requested the additional Commissioner of Police, Western Zone to appear before us through video-conferencing in order to explain the negligent conduct of the officials on duty at the Kherwadi Police Station. 5. Since the additional Commissioner of Police of North Region is indisposed, Mr. Pravin Padwal, In-charge additional Commissioner of Police, Western Region who is also additional Commissioner of Police, North Zone has appeared before us alongwith the Deputy Commissioner of Police, Zone-8. We do not blame Mr. Pravin Padwal for not being appraised of the facts in the matter since he has appeared before the Court within ten minutes of the Court asking him to do so. However, we are not at all satisfied with the explanation given to us by the Deputy Commissioner of Police, Zone-8, Mumbai, more particularly, when we enquired whether the concerned officials have prepared any report regarding what had conspired at the Police Station and how the said lady who was brought to the Police Station was not taken care of to the extent of ensuring that she should not leave the Police Station more so, when they were aware that the said lady is suffering from alzheimers (dementia). However, as usual no action whatsoever was taken against the erring officers by their superiors. 6. Before we pass any strictures against the erring officers, we direct the Deputy Commissioner of Police to file his affidavit alongwith the affidavits of Ms. Vijaya Gawade, Duty Officer, Kherwadi Police Station, Mr. Raju Gaikwad, amaldar and Mr.

Before we pass any strictures against the erring officers, we direct the Deputy Commissioner of Police to file his affidavit alongwith the affidavits of Ms. Vijaya Gawade, Duty Officer, Kherwadi Police Station, Mr. Raju Gaikwad, amaldar and Mr. Dalvi of Kasarvadavali Police Station and other concerned officials setting out the facts pertaining to the mother of the Petitioner and to leave no stone unturned, in tracing the whereabouts of the mother of the Petitioner by circulating her photographs to all the Police Stations in all the States as well as Hospitals, Mental asylums, old age homes, morgues seeking all information available qua the missing lady's movements. 7. Stand over to 31st December, 2021 at 12.00 noon.
