Judgment Mr. Avneesh Jhingan, J. :-This petition under Section 439 Cr.P.C. is filed seekingregular bail in case FIR No. 409, dated 11th October, 2020, under Sections3 and 13(3) of the Haryana Gauvansh Sanrakshan and GausamvardhanAct, 2015, registered at Police Station Punhana, District Nuh. 2.The police party received a secret information on 11th October,2020 that Salim, Moosa and Bhuri@ Akthar are indulged in business ofcow slaughtering. On that date they were slaughtering the cow in the houseof Moosa. A raid was conducted, the accused fled away from the spot.Hundred kilograms of beaf, two big knives and weighing scale wererecovered. 3.Learned counsel for the petitioner submits that petitioner is incustody since 24th July, 2021, investigation is complete, petitioner was notapprehended from the spot and no recovery was made from him. 4.Learned State counsel opposes the prayer for grant of regularbail and submits that petitioner was specifically named in the secretinformation. She further submits that petitioner is involved in five moresimilar cases. 5.Mere involvement of the petitioner in other cases in itselfwould not be a ground to deprive his personal liberty. Without making anycomments on merits of the case, considering that petitioner was neitherapprehended from the spot nor any recovery was made from him,investigation is complete and conclusion of the trial is likely to take time,petitioner is granted bail subject to his furnishing bail bonds to thesatisfaction of the Chief Judicial Magistrate/ Duty Magistrate concerned. 6.The petition is allowed. 7.It is clarified that observations made hereinabove shall not beconstrued as an expression of opinion on the merits of the case. 8.Since main petition is decided, pending applications if anystands disposed of.
