Judgment Mr. Deepak Sibal, J. The present petition has been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in FIR No.0098 dated 02.08.2021 registered under Sections 323, 452, 34 IPC (Section 307 IPC subsequently added) at Police Station Jakhal, District Fatehabad. 2. On September 22, 2021, this Court had passed the following order:- “The matter has been taken up through video conferencing. Status report filed by the State is taken on record. For arguments, adjourned to 14.12.2021. Seeking ad interim anticipatory bail for the petitioner, learned counsel submits that the petitioner has been falsely implicated in this case due to enmity between the petitioner and the complainant; the petitioner has no other criminal case pending against him; even if the case of the prosecution is taken as the gospel truth, though vehemently denied, the injured’s MLR does not corroborate the version given in the FIR with regard to injuries inflicted by the petitioner; as per the injured’s MLR, there is only one injury on his person and the same is attributed to co-accused Satnam and that the petitioner is ready and willing to join investigation as and when called by the investigating agency. Considering the above submissions and the status report filed by the State, subject to the petitioner’s joining investigation as and when called by the investigating agency as also abiding by the other conditions provided under Section 438(2) Cr.P.C., in the event of his arrest in FIR No.0098 dated 02.08.2021 under Section 323, 452, 34 of IPC (Section 307 of IPC added subsequently) at Police Station Jakhal, District Fatehabad, he shall be released on ad interim bail to the satisfaction of the Arresting Officer.” 3. Learned State counsel submits that under the afore-quoted order passed by this Court, the petitioner has joined the investigation; cooperated with the investigating agency and that his custodial interrogation is not required by the State. 4. In view of the above, the interim order of this Court dated 22.09.2021, granting ad interim anticipatory bail to the petitioner is made absolute.
