JUDGMENT Chandra Kumar Songara, J. - This second bail application has been filed under Section 439 of Cr.P.C. in connection with FIR No. 16/2021 registered at Police Station Jhalarapatan, District Jhalawar, for the offence under Section 8/21 of NDPS Act. 2. Learned counsel for the petitioner submits that petitioner is in judicial custody since 09.01.2021. Charge-sheet has already been submitted. As per rejection bail order, petitioner has criminal antecedents of fourteen cases and he is on bail in all cases. Bail applications of co-accused Ramprasad and Nanuram under Section 439 CrPC have already been granted by this Court. Hence, the petitioner may be released on bail. 3. Learned Public Prosecutor has opposed the bail application. 4. Considering the submissions made by learned counsel for the petitioner and taking into consideration overall facts and circumstances of the case but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to enlarge the petitioner on bail. 5. Accordingly, the second bail application under Section 439 of Cr.P.C. is allowed and it is ordered that the petitioner Bherulal S/o Kanwarlal shall be enlarged on bail; provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
