ORDER : Arup Kumar Goswami, J. 1.None appears for the Petitioner. 2. Heard Mr. G.L. Nageswara Rao, Government Pleader for Revenue. 3.This Public Interest Litigation is filed questioning the action of the Respondents in proposing to construct houses in the part of the land of State Seed Farm in Survey No. 184-1, Amaravati Village and Mandal, Guntur District. 4. On 15.03.2021, the following order was passed: “Mr. Manikanteswara Rao Kotha, learned counsel, appears for the petitioner. Though Mr. G.L. Nageswara Rao, learned Govt. Pleader for Revenue, for respondents 1 to 6 submits that counter-affidavit is filed, note of the Registry indicates that no counter-affidavit was filed till 08.03.2021. He prays for some time to ascertain factual position and do the needful. It is submitted by Mr. G.L. Nageswara Rao that land is not sought to be taken for grant of house-sites, as an alternative site has been chosen for the purpose. List the case after two weeks.” 5. In the counter affidavit of Respondent No. 4, at paragraph no. 6, it is stated as follows: “It is respectfully submitted that, the Revenue Divisional Officer, Guntur submitted a report Dt.20.10.2020 based on the report submitted by the Tahsildar, Amaravathi holding that, in view of Hon’ble High Court stay orders (Status quo) granted in the present WP (PIL), private patta lands were identified in S.No. 188 and 189 of Amaravathi village to an extent of Ac.10-82 cents and an extent of Ac.2-58 cents for the land situated in S. No. 78/B of Dharanikota Village for providing house sites to the eligible beneficiaries under ‘Pedalandariki Illu programme’ and that land compensation amounts were also credited into the accounts of the land owners concerned to the extent of land acquired and layouts/plots were developed and put the land ready for distribution to the beneficiaries. Finally, the Revenue Divisional Officer, Guntur reported that there is no need to resume the lands from Agriculture Department i.e., State Seed Farm, Amaravathi which were covered under PIL 70 / 2020. Subsequently, the house site pattas were distributed in the aforementioned land to the beneficiaries in the month of January 2021.” 6.
Finally, the Revenue Divisional Officer, Guntur reported that there is no need to resume the lands from Agriculture Department i.e., State Seed Farm, Amaravathi which were covered under PIL 70 / 2020. Subsequently, the house site pattas were distributed in the aforementioned land to the beneficiaries in the month of January 2021.” 6. In view of the categorical statement made in the aforesaid paragraph that there is no need to resume the lands from State Seed Farm, Amaravathi, which is covered under this Public Interest Litigation, and that subsequently house site pattas were distributed after acquiring private patta lands, no further orders are called for in this Public Interest Litigation and, accordingly, the same is closed. No order as to costs. 7. All the pending miscellaneous applications, if any, are closed.
