JUDGMENT : Ravi Malimath, J. 1. This petition has been filed on the ground that the order dated 02.03.21, passed by the Division Bench, has been disobeyed. It is contended that, that part of the order wherein it is stated by the Division Bench that the promotions shall be made as per rules, has been disobeyed and that the promotion has been made in opposition to the rules. Therefore, it is contempt. 2. On hearing the learned counsels, I’m of the considered view that this is not a matter where proceedings for contempt can be initiated. It is not necessary for the Court to say that promotions shall be made as per rules. The demand of the law is that all promotions should always be made in accordance with law. In case such a promotion is not in accordance with law, the same does not constitute disobedience of the order but an irregularity or an illegality which requires to be agitated before the concerned Court itself. Therefore, reserving a liberty, I do not find any ground to entertain this petition. Hence, the same is dismissed.
