JUDGMENT Anoop Kumar Dhand, J. - This bail application under Section 439 Cr.P.C. is laid by petitioner in connection with an FIR No.59/2021, registered at Police Station Rol, District Nagaur, wherein she is charged for offences punishable under Sections 498-A & 306 IPC. 2. It is contended on behalf of petitioner that petitioner is maternal grandmother-in-law of deceased. During the course of investigation, prosecution has not submitted any evidence which indicates that the deceased was abated by the petitioner to commit suicide. He further submits that after completion of investigation, when police submitted charge-sheet it was found that there was quarrel of domestic affair between petitioner and co-accused Shamsher Khan with the deceased and when deceased was not allowed to visit her parental home, she committed suicide. It is further stated that the petitioner is a lady and seeking indulgence of bail as per proviso under Section 437 Cr.P.C. 3. Per contra, learned Public Prosecutor as well as learned counsel for the complainant opposed the bail application and stated that there are ample evidence against the petitioner that she alongwith co-accused tortured deceased. 4. Having heard learned counsel for the parties and considering the fact that petitioner is a lady and maternal grandmother-in-law of deceased having no criminal antecedents and after completion of investigation, charge-sheet has been filed and trial will take its own time, without expressing any opinion on merits of the case, I deem it just and appropriate to grant indulgence to the petitioner by enlarging him on bail. 5. Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that accused-petitioner Smt. Kamroon Bano @ Kamo W/o Shri Bhanwaroo Khan, arrested in connection with F.I.R. No.59/2021, Police Station Rol, District Nagaur may be released on bail; provided she furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
