ORDER : 1. Heard. 2. All these matters have come up for hearing for the reason that the special mention was made on account of the fact that fresh notification has been issued by the University, whereby the off-line examination for B.Sc. Nursing, M.Sc. Nursing and Post Basic B.Sc. Nursing, is scheduled to be held from 16th of August, 2021. 3. On the earlier occasion when the examination was scheduled to be held from 6th & 10th of July, 2021 the challenge was made that the centers have been made in clusters and at that point of time since the Covid infection was at its peak, as such, without the permission of the Government off-line examination should not be held. This Court after hearing the issue on 02.07.2021 observed that since the pandemic period and lock-down was not completely relaxed and the State Government has issued a circular dated 21.04.2021, which purports that after obtaining permission from the State, the off-line examination can be held by the University and as the permission was not existing, as such this Court had deferred the examination which was scheduled to be held from 06.07.2021 & 10.07.2021. Subsequently, again a request was made by the petitioners that a general promotion be granted. This Court on 22.07.2021 had passed the following orders:- “Having considered the demand of the petitioners students that they should be promoted without taking the examination appears to be unreasonable. The work to be discharged by the petitioners is of nursing looms into view. The collective enthusiasm by the students cannot be accepted. Solving certain problem requires multi-prolonged approach and any order of like nature and directing the respondent to give general promotion to the students would amount to encroach upon academic turf by this Court and would be contrary to general expectation of society. The works the petitioners are required to discharge are directly related to individual ailing one as such if they are passed out by general promotion without any examination the scale of devastation may be horrifying in future. The demand, as appears, is not bonafide as the students only want that they should be promoted without taking the examination and that too, in the course of Nursing. Therefore, the prayer of the petitioners that general promotion should be granted is completely unjustified and illogical which cannot be acceded, hence such prayer is rejected.” 4. Now the new schedule since has been issued it is contended that the petitioners are not hesitant to take the off-line examinations, however, the examination centers wherein cluster of colleges are made to one center may not be conducted and individual colleges may be directed to conduct the examination to avoid the probability of covid infection and large congregation. 5. After reading such notification it shows that the University has been allowed to physical opening of all the colleges from 02.08.2021 with certain precautionary restrictions. Therefore, the permission has already been allowed by the State to conduct the off-line classes as such, I do not see any reason as to why the offline examination should be stopped only for the reason that certain clusters of colleges have been formed as examination centers. It is obvious and expected that the respondent Universities and colleges would adhere to the directions recently given by the State on 26.07.2021 to take care of all precautionary measures. Consequently, the off-line examinations which are scheduled are allowed to be held for the B.Sc. Nursing, M.Sc. Nursing and Post Basic B.Sc. Nursing courses from 16th of August, 2021 subject to strict precautionary compliance and the direction issued by the State Government. 7. With such observation, all the writ petitions stand disposed of.
