JUDGMENT Sudip Ahluwalia, J. - The instant Petition has been filed under Section 439 of the Code of Criminal Procedure seeking Regular Bail on behalf of the Petitioner in case FIR No.101, dated 9th November, 2019, registered under Sections 363, 366-A of the Indian Penal Code, at Police Station Kheri Gandian, District Patiala. 2. The Petitioner by now has remained in detention for almost 09 months since 15th March, 2020. 3. After completion of investigation, Challan against him has already been submitted. 4. Evidence from the Prosecution Side is yet to commence. 5. It has been reported by Ld. State Counsel that the Prosecutrix who in any case had not given any damaging statement against the Petitioner during her examination under Section 164 of the Cr.P.C. (Annexure P-2) before the Ld. Judicial Magistrate 1st Class, Rajpura, has already been married and is presently residing in her in-laws house. 6. In the circumstances, considering the long detention undergone by the Petitioner and without commenting upon the other merits of the case as also keeping in view the fact that the trial is likely to take a considerable time to conclude in view of the on-going Covid-19 Pandemic, at this stage, this Court is of the opinion that further detention of the Petitioner for an indefinite period is not called for. As such, he is ordered to be released on bail subject to the satisfaction of the Ld. Trial Court/Duty Magistrate concerned. 7. Disposed off.
