JUDGMENT Dinesh Mehta, J. - By way of the present writ petition, the petitioners have sought a direction to the respondents to postpone the examinations scheduled on 18.2.2021. 2. Ms. Bhati, learned counsel appearing for the petitioners invited Court's attention towards various notifications and press releases issued by the respondent-Commission and highlighted that examination for the post of Assistant Forest Conservator and Ranger Grade-I in furtherance of advertisement dated 4.4.2018 have been postponed on many occasions. 3. Learned counsel submitted that the respondent-Commission itself has postponed examinations at least on 7-8 occasions. 4. She submitted that now the exams are being convened between 18.2.2021 and 26.2.2021; when the exams of Assistant Central Intelligence Officer Grade-II are also being conducted. 5. According to learned counsel since both the exams are being held on 18.2.2021, the petitioners will have to forego one of the examinations, which would adversely affect their rights. 6. While pointing out that only two chances are permissible for the post of Assistant Central Intelligence Officer Grade-II and that the petitioners have already submitted their application forms, if they do not appear, their non-appearance too will be counted as an attempt, she prayed that the respondents be directed to postpone the ensuing examination for the post of Assistant Forest Conservator and Ranger Grade-I. 7. During the course of submissions, learned counsel also invited Court's attention towards the communication dated 10.2.2021 sent by the Principal Conservator of Forests who has written that if the exams are postponed, the same will be beneficial to all because about 33 extra vacant posts will be available for recruitment. 8. In considered opinion of this Court fixing the schedule of examinations is the sole domain of employer or recruiting agency. Merely because the dates of other exams or recruitment are clashing, the petitioners cannot claim postponement of examination, which the respondent-Commission is conducting. 9. If the petitioners' request is acceded to, there may be hundreds of such candidates, who are appearing in one examination or the other and on the ground of clashing dates of examination, every examination will be postponed. May be another candidate can pray for the exams of Assistant Central Intelligence Officer to be postponed so that he can appear in the recruitment under consideration. 10. It is for the petitioners to choose, which exam is suitable to them. 11. Examinations are scheduled tomorrow. Any indulgence in the eleventh hour would lead to not only administrative difficulties and unwarranted financial implications,but also adversely affect the sentiments of all other candidates, who are all set to appear in the examinations scheduled tomorrow. 12. At the instance of petitioners, the Court cannot issue direction to postpone examination 13. This Court does not find any legal right in petitioners' favour for the relief they have claimed. 14. The writ petition is, therefore, dismissed. 15. The stay application also stands disposed of accordingly.
