ORDER 1. This matter is taken up through video conferencing mode. 2. Heard Mr.Sarat Kumar Acharya, learned counsel for the petitioners and Mr.G.R.Mohapatra, learned Additional Standing Counsel. 3. According to Mr.Acharya, the petitioners, who are residents of Ward No. 9 Jagannath Lane Mandap Basti, Chandrasekharpur, Bhubaneswar are aggrieved by the non-inclusion of their names in the list of beneficiaries under Rajiv Awas Yojana. He further submits that though highlighting all their grievances the petitioners have submitted a representation on 20.9.2021 under Annexure- 8 series before the Commissioner, Bhubaneswar Municipal Corporation (opposite party No.6) however till date nothing has been done, instead a move is on to evict them from their present place of residence. In such background, he prays that a direction be issued to opposite party No.6 to take a decision on the above noted representation under Annesxure-8 series within a specific time period and for the interregnum, their interest be protected. 4. Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the Commissioner, Bhubaneswar Municipal Corporation (opposite party No.6) to take a decision on the above noted representation dated 20.9.2021 under Annexure-8 series in accordance with law within a period of four weeks from the date of receipt of certified copy of the order along with a copy of the above noted representation and communicate the result of such exercise to the petitioners. It is further directed that till disposal of the representation dated 20.9.2021, no coercive action shall be taken against the petitioners. 5. Office is directed to communicate this order to opposite party No.6 forthwith at the cost of the petitioners, requisites for which shall be filed by tomorrow (30.9.2021). 6. Accordingly, the writ petition is disposed of. 7. Urgent certified copy of the order be granted on proper application.
