JUDGMENT : Pankaj Bhandari, J. 1. The appellant has preferred this appeal aggrieved by order dated 16.01.2021 passed by Special Judge, SC/ST (Prevention of Atrocities) Cases Kota whereby bail application filed by the appellant was rejected. 2. F.I.R. No. 208/2020 was registered at Police Station Sultanpur Kota for offence under Secs. 376-D, 354, 367, 368 I.P.C. and Section 3(2)(v) SC/ST Act. 3. It is contended by the counsel for the appellant that prosecutrix is in a habit of lodging cases by involving the persons in honey trap. Some cases have been produced before the Court which goes to show that the prosecutrix is involved in lodging of honey trap cases. 4. Learned Public Prosecutor and counsel for the complainant have opposed the appeal. 5. I have considered the contentions. 6. Considering the contentions put-forth by the counsel for the appellant, I deem it proper to allow the appeal. 7. The order dated 16.01.2021 is set aside and the appeal is allowed and the appellant is directed to be released on bail provided he furnishes a personal bond of Rs. 1,00,000/- (Rupees One Lakh only) and two sureties in the sum of Rs. 50,000/- (Rupees Fifty thousand only) each to the satisfaction of the learned trial court with the stipulation to appear before that Court and any court to which the matter is transferred, on all dates of hearing and as and when called upon to do so. 8. The fact that prosecutrix is involved in honey trap cases, should be brought to the notice of the Police Authorities to take appropriate action. 9. However, if the documents produced by counsel for the appellant are found to be fake or are not pertaining to the prosecutrix, complainant-respondent would be free to move application for cancellation of the bail.
